Also, the subprime mortgage crisis still persists whereby the fair market value of the mortgaged real estate is not in line with the loan given to acquire the property. We typically seek a loan modification for such clients and draft any plausible defenses if the home is in foreclosure. Usually we are successful if our clients have not previously entered a modification and are gainfully employed. However, if the client is too far into the foreclosure sale process, we explore Chapter 13 Bankruptcy as a means of saving our clients home.
