What to do if you are being sued?
For starters, please do not panic. Civil Courts are judicial forums where people file complaints and seek the courts guidance to render a decision. Secondly, make sure you are aware of the plaintiff and you are familiar with the transaction in question. We’ve tried many cases where a simple validation request of the debt would have been sufficient to prevent the lawsuit. Cases that fall into this category are usually from Debt Collectors or Debt Purchasers that acquire delinquent accounts with insufficient documentation to establish the chain of title. Debt Purchasers rely on noncompliance of the debtor and are eager to get a default judgment.
If you are being sued you should receive a summons and a complaint from the county in which the action was filed. Upon receiving complaint, you are given 35 days to draft a response. When drafting a response it is mandatory that a copy of the response be sent to the local court and opposing counsel. At this time negotiation typically begins and our lawyers will fight to ensure you get the best outcome. Our services include hands on management of discovery.
